Check SuitabilityFrequently Asked Questions
What does a Clean Break Order do?
A Clean Break Order is a type of financial consent order. Once approved by the court, it can end financial claims between former spouses or civil partners, subject to the terms of the order. Without one, financial claims may remain open even after divorce or dissolution.
Is a Clean Break Order legally binding?
A Clean Break Order only becomes legally binding once it has been approved by the court. An agreement that has not been approved by the court does not have the same legal effect.
Do both parties have to agree?
Yes. A Clean Break Order is a consent order, so both parties must agree to its terms and sign the application before it is submitted to the court.
I previously owned a property but have since sold it. Do I qualify for the £179 service?
No. Our £179 Clean Break Order service is only available if neither party currently owns or has ever previously owned a property. This applies even if the property has since been sold. Our Standard or Express Consent Order services may be suitable instead.
Do dependent children or pension sharing make me ineligible?
Yes, for our £179 service. If either party has financially dependent children, or pension sharing is required, please choose our Standard or Express Consent Order service instead.
What happens if the court does not approve the application?
Court approval cannot be guaranteed. The court may ask for further information, request changes to the order, or decline to approve it. If the court raises queries, these will need to be addressed before the order can be approved.
